In a landmark order, the Rajasthan High Court has emphasized that the object of criminal justice is not merely punitive, but reformative and humane, while granting temporary bail to an accused under the NDPS Act.
Despite the seriousness of the allegations under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, the Hon’ble Court acknowledged that humanitarian considerations and constitutional values of dignity and compassion must not be overshadowed by the gravity of accusations alone.
🧾 Court’s Observations:
> “The object of criminal justice is not only to punish, but to also uphold human dignity, offer reformative opportunity, and to remain sensitive to the humanitarian aspect of incarceration.”
🗣️ Dr. Anthony Raju, Advocate, Supreme Court of India and Chairman of the Indian National Human Rights Protection Council, commended the ruling, stating:
> “These are highly impactful words by the Hon’ble Court, reinforcing the essence of human rights even within the contours of criminal law. Justice must never lose its humane face — and this judgment is a strong reminder that reform and rehabilitation must co-exist with enforcement.”
He further added that courts across India must draw inspiration from such jurisprudence to ensure jail is not a default rule, especially when bail is the norm and humanitarian factors prevail.
