STEP-BY-STEP LEGAL STRATEGY IN FALSE RAPE CASES
1. ANTICIPATORY BAIL – CrPC SECTION 438
File Anticipatory Bail Application immediately if FIR is lodged but arrest has not been made.
Emphasize on lack of medical evidence, delay in FIR, absence of prior complaint, and existing civil/matrimonial disputes.
Present WhatsApp chats, CDRs, and other digital evidence showing consent or falsity.
Argue clean antecedents and cooperation with investigation.
> Note: While CrPC 438 is the traditional section for anticipatory bail, many High Courts entertain it under Section 439 for broader relief, especially in POCSO and serious IPC sections.

2. REGULAR BAIL – IF ARRESTED
If the accused is in custody, file Regular Bail under CrPC 439 before the Sessions Court or High Court.
Stress no need for further custodial interrogation, fabricated allegations, and contradictions in the complainant’s statement.
Bring attention to non-compliance of Section 164 CrPC statements or delayed statements to question credibility.

3. OPPOSING FALSE CHARGES – CrPC SECTIONS 211 & 182
After securing bail, initiate action against false accuser:
Section 211 IPC: False charge with intent to injure.
Section 182 IPC: Providing false information to a public servant.
Section 120B IPC: Criminal conspiracy (if more parties involved).
File complaint for criminal defamation (Section 499/500 IPC).
Seek direction from Magistrate for police investigation under Section 156(3) CrPC.

4. DISCHARGE APPLICATION – CrPC SECTION 227 / 239
File a Discharge Application before the Trial Court:
Section 227 CrPC: Sessions trial.
Section 239 CrPC: Magistrate trial.
Argue lack of prima facie evidence, absence of medical corroboration, or inconsistencies in statements under Section 161/164 CrPC.

5. QUASHING OF FIR – HIGH COURT UNDER SECTION 482 CrPC / WRITS
File a petition under Section 482 CrPC before the High Court to quash FIR:
When there’s clear abuse of process.
When allegations are inherently improbable.
Alternatively, file a Writ Petition (Article 226/227) for protection of fundamental rights or misuse of legal process.

6. DEFAMATION AND CIVIL DAMAGES
File a civil defamation suit and claim compensation for loss of dignity, employment, and reputation.
File under law of torts for malicious prosecution.
